人權與國際知識產權保護

摘    要

與貿易有關的知識產權協議的產生，在促進知識產權國際保護發展的同時，也造成了知識產權制度與國際人權法之間的沖突。從立法宗旨上講，不管對知識產權采用什么樣的措辭，知識產權保護應與維護人類尊嚴和實現其他人權相1致。因此，我們必須開展有關研究工作，探尋如何在包括TRIPS在內的國際條約框架下，協調好知識產權與人權之間的沖突---價值連帶和制度互動的問題。具體說來說，知識產權國際保護制度必須以國際人權公約的價值取向為指導，在保護公共健康權、隱私權等方面進行制度改革。

ABSTRACT

The emergence of TRIPS is thought to promote the international protection of intellectual property while engender the conflicts between intellectual property system and internatinal human rights law.From the tenet of legislation,regardless of any experssions being used to intellectual property, the protection of intellectual property should be accorded with the protection of human dignity and realization of other human rights.Consequently, we must develop related research work to search how to harmonize the relationship between intellectual property and human rights under the framework of international treaties included in TRIPS---the problem of related value and mutual system.In details,the system of international protection of intellectual property must make public health,privacy,etc. under the direction of the value orientation of international pacts concerning human rights.
