論灘涂承包經營權的效力

摘 要

灘涂承包經營權,是指公民、集體依法對集體所有的、或者國家所有由集體使用的灘涂進行承包經營的.權利。灘涂承包經營權的基本權利主要包括灘涂占有權、經營自主權、經營收益權及依法處分權等權能；基本義務主要包括不得隨便改變灘涂農業用途、合理開發利用灘涂、灘涂不得拋荒及負有容忍國家征收等義務。我國現行法律對灘涂承包經營權的權利與義務規定還有1些不足，立法機構應從以下幾方面完善我國灘涂承包經營權制度：規范灘涂所有人的行為；對公共利益進行界定；健全補償機制；對灘涂承包經營權權利的行使加以限制。

Abstract
