        論控審分離原則

        摘   要

        控審分離原則是現代刑事訴訟活動中的1項重要原則。我國現行的刑事訴訟法已經體現了控審分離原則的精神,但對于這1原則貫徹還不夠徹底。在偵查、審查起訴和審判程序中還存在許多與該原則精神相背離的地方。界定控審分離原則的基本內涵,闡述其理論基礎和意義,分析控審分離原則在我國司法實踐中的現狀,指出控審不分對我國法治的危害,并借鑒外國立法提出完善立法和司法的建議,無疑有利于我國刑事訴訟法制的現代化。

        ABSTRACT

        The separation principle between charge and interrogation is a cardinal principle in modern criminal prosecution activities. The existing code of criminal procedure has already embodied the spirit of this principle, but can hardly carry it out thoroughly. There are many issues which deviate from the very principle in reconnaissance, investigation, charge and interrogation and some other procedures. To define the basic connotation of this principle, elaborate its rationale and significance , analyze current situation of it in our judicial practice , point out the harm effects of indictment mixing with judgment in China’s rule by law, then profit from the foreign legislation and propose some suggestion to perfect the legislation and judiciary, will undoubtedly  beneficial to the modernization of Chinas criminal procedure legal system.
