從《缺陷汽車產(chǎn)品召回管理規(guī)定》看中國產(chǎn)品召回法律制度

摘  要

產(chǎn)品召回是消費(fèi)者權(quán)益保護(hù)的1項(xiàng)重要制度，自上世紀(jì)610年代在美國確立以來，也因其注重對(duì)消費(fèi)者權(quán)益的保護(hù)而在世界范圍內(nèi)得到廣泛推廣�！度毕萜�車產(chǎn)品召回管理規(guī)定》的頒布實(shí)施，為我國產(chǎn)品召回法律制度的建立開啟了1個(gè)良好的開端。但它只是整個(gè)產(chǎn)品召回制度中的1小部分，我國的產(chǎn)品召回法律制度還需要進(jìn)1步完善，以適應(yīng)保護(hù)消費(fèi)者權(quán)益的根本需求。本文主要從引入國外產(chǎn)品召回制度中的懲罰性賠償制度加強(qiáng)威懾機(jī)制，完善產(chǎn)品召回法律方面，以及適用產(chǎn)品召回保險(xiǎn)降低召回風(fēng)險(xiǎn)方面提出了1些建議。

ABSTRACT

The product recall is an important system on the consumers’ rights and interests protection. Since the last century 60s, it has been established in America, because of its attention to consumers’ rights and interests protection , it has spreaded widely in the scope of the world. “Management Stipulation On Flaw Automobile Product Recall ”promulgated and put into effect , open a good beginning for our country to establish the product recall legal system. But it is only a small part of the whole product recall system .The product recall legal system in our country needs further consummate to adapt the essential demand for the consumers’ rights and interests protection. This thesis will be mainly from quoting overseas product recall system about punitive compensation system to strengthen the deterrent mechanism, consummating the product recall system and suitting product  recall insurance to reduce  recall risks, to put forward some proposals.
